General Terms and Conditions of Sale

    1. Purpose

    These General Terms and Conditions of Sale govern the contractual relations between Domaine Tarbouriech and the customer for any reservation or service offered by Domaine Tarbouriech, the restaurant La Folie, the Ostreatherapie spa and the ancillary facilities (swimming pool, etc.).

    Group and event offers are governed by specific general terms and conditions of sale which are sent with the quotes by our sales department.

    It should be noted that there is no right of withdrawal applicable when purchasing leisure services on a specific date

    2. Booking

    2.1 Booking terms

    Reservations can be made online via our website, by phone or directly at the reception. All bookings become effective upon receipt of written confirmation by the establishment.

    2.2 Pre-contractual information

    The Client acknowledges that he or she has been informed, prior to placing an order and/or concluding the contract, in a legible and comprehensible manner, of these general and special terms and conditions of sale and of all the information listed in Article L. 221-5 of the Consumer Code.

    2.3 Children

    Accommodation:

    Possibility to install a cot free of charge (0 to 3 years old).

    From 3 to 12 years old a supplement of 45€ per child is applicable and includes the extra bed and breakfast.

    Above 12 years old the adult supplement rates apply: 112€ including the extra bed and breakfast.

    Spa:

    Children under 16 years old must be accompanied by an adult and their access to certain facilities (hammam, sauna, etc.) or treatments may be restricted.

    2.4 Animals

    Pets are allowed, for an extra charge of €20 per night, but access to the restaurant, swimming pool and treatment area is prohibited.

    Animals must remain on a leash when moving within the public space of Domaine Tarbouriech and owners are responsible for any potential damage as well as the collection of their pets’ droppings.

    2.5 Parking

    Free outdoor parking with electric charging stations at no extra charge.

    2.6 Internet access

    Domaine Tarbouriech offers free WIFI access allowing the Customer to connect to the Internet. The Client undertakes to ensure that the computer resources made available to it are not used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, etc. audiovisual works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code when such authorisation is required. The Client is required to comply with the security policy of Domaine Tarbouriech’s internet service provider, including the rules for the use of security means implemented in order to prevent the illicit use of computer resources, and to refrain from any act that undermines the effectiveness of these means. If the Client does not comply with the above-mentioned obligations, it may be accused of an infringement offence (Article L.335-3 of the Intellectual Property Code), punishable by a fine of three hundred thousand (300,000) euros and three (3) years’ imprisonment.

    2.7 Booking guarantee

    To guarantee the stay, the reservation must be confirmed by a deposit of 30% of the entire stay (unless there is a non-cancellable, non-refundable offer for which full prepayment is required). The booking confirmation will be sent after confirmation of the direct debit granted by the bank. Upon arrival, the guest will be asked to present a credit card as a guarantee as well as an identity document.

    2.8 Cancellation conditions

    Any cancellation, even partial, must be expressed in writing. No cancellation of stay will be taken into account by phone call.

    Regarding accommodation:

    • Free cancellation : Any cancellation can be made free of charge up to 15 days before the date of arrival (18:00 local time) except for a special non-modifiable/non-refundable rate, the full amount of which will be due regardless of the date of cancellation.
    • Late cancellation : Less than 3 days before the arrival date (18:00 local time), the total amount of the stay will be charged as a cancellation fee.
    • No-show : In case of no-show on the scheduled date (No-Show), the entire stay will be charged.

    Concerning the Spa:

    • In the event of treatments booked in our Spa, but not honored and not cancelled before 6 p.m. the day before the service, you will be charged the full amount of the reserved service
    • Any changes before 6 p.m. the day before the performance will be made free of charge subject to availability.
    • In the event of a delay by the client, the duration of the service may be reduced so as not to disrupt subsequent appointments. The initial price of the service will remain applicable.
      If the delay exceeds 15 minutes, the establishment reserves the right to cancel the service and charge the full price of the service.

    About the restaurant:

    • A credit card imprint is required for all bookings of 5 people or more. In case of no-show, the amount of 30€ per person booked will be charged.
    • Some services or events (Christmas, New Year’s Eve, Valentine’s Day,…) may be subject to special conditions such as full prepayment of the service in order to guarantee the reservation. For this type of meal, any total or partial cancellation will be charged in full.

    3. Rates

    3.1 Pricing

    The prices displayed on the website and the establishment’s communication media are in euros and include VAT. Rates may vary depending on the season and promotional offers. Tourist taxes are not included in the price and must be paid on site. All our rooms are non-smoking. Our rates are offered on a double occupancy basis. Any additional person may be subject to specific invoicing under the conditions indicated in article 2.2.

    3.2 Changes to tariffs

    The establishment reserves the right to modify its rates at any time according to its price optimization policy. The price confirmed at the time of booking is guaranteed.

    Thus, if the public rate on our site www.domaine-tarbouriech.fr If the one confirmed at the time of booking, no changes will be applied. Similarly, if the daily rate is lower than the rate confirmed at the time of booking, it will not be possible to use it in order to obtain a downward adjustment of the latter.

    3.3 Tourist taxes

    A tourist tax of €1.15 will be collected for each adult over 18 years old for each night of the stay. This tourist tax is not included in the packages offered and will be collected at the end of the stay.

    4. Rules

    Payment for services is made on site on arrival or departure, according to the terms and conditions agreed at the time of booking (credit card, cash, transfer, gift voucher).

    5. Additional services

    5.1 Restaurant

    The hotel’s restaurant offers set menus and à la carte dishes. It is advisable to book a table in advance to guarantee availability. The Domaine’s restaurant “La Folie” is open daily for breakfast, lunch and dinner.

    5.2 Spa

    SPA services must be booked in advance, either directly at the reception of the Domaine, via the website, or by phone.
    A deposit of 100% of the total amount of the service may be requested at the time of booking.
    The Spa is open from 10 am to 7 pm every day.

    Anyone accessing the SPA must comply with the health and safety rules posted in the establishment (see internal regulations).

    It is the client’s responsibility to report any particular medical condition (allergies, pregnancy, heart problems, etc.) that may affect the use of the SPA services. The establishment declines all responsibility in the event of an incident resulting from the non-communication of this information.

    The SPA provides lockers to store personal belongings. However, the establishment declines all responsibility in the event of theft, loss or damage to personal objects within the SPA. It is recommended that you do not bring valuables into the SPA.

    The SPA is a space for relaxation. Customers are asked to respect the peace and quiet of other users by maintaining an appropriate noise level.

    Any damage to the SPA’s facilities or equipment engages the responsibility of the customer and may result in repair costs.

    The SPA is committed to offering services that comply with health and safety standards.

    In the event of an accident or injury within the SPA, the establishment’s liability will be limited to the legal provisions in force. Guests are encouraged to purchase personal insurance to cover any mishaps while using the facilities.

    5.3 Swimming pool

    Access to the swimming pool is reserved for guests of Domaine Tarbouriech as well as for customers who have purchased access under specific conditions. The Swimming Pool is open from May to October from 9:00 am to 7:00 pm and can be heated during all or part of this period.

    Swimming is not supervised and children must be accompanied by an adult. Wearing a swimsuit is mandatory. The internal rules of the swimming pool are posted around it in order to provide more details on the rules related to this service.

    6. Conditions of stay

    6.1 Check-in and Check-out

    • Check-in : Rooms are available from 16:00.
    • Check-out : Rooms must be vacated by 11:00 am. Any overruns may result in additional charges.
    • Early arrivals and late departures can be arranged for an additional fee to be confirmed with the reception.

    6.2 Respect for the site

    Guests are required to respect the calm and cleanliness of the premises. The property reserves the right to terminate the stay of any guest who does not comply with these rules without compensation.

    7. Responsibility of the institution

    The establishment declines all responsibility in case of theft, loss or damage to guests’ personal belongings in the rooms, the spa, the restaurant, or the common areas. A safe is available to guests in the rooms for valuables. Code lockers are available to guests at the Spa.

    8. Force majeure

    The establishment cannot be held responsible for the non-performance of its obligations in the event of force majeure, as defined by French legislation (natural disaster, fire, strike, pandemic, etc.).

    9. Complaints

    Any complaints regarding the stay must be reported to the establishment directly to our reception teams by phone or by e-mail at contact@domaine-tarbouriech.fr

    10. Protection of personal data

    The personal information collected during the booking is used exclusively for the purposes of managing the booking and communication between the establishment and the guest. In accordance with the regulations in force, the customer has the right to access, rectify and delete their data.

    11. Applicable law and disputes

    After contacting the after-sales service and in the absence of a satisfactory response or in the absence of a response within 60 days, the customer may refer the matter free of charge to the Tourism and Travel Mediator, whose contact details and referral procedures are available on its website: www.mtv.travel

    These T&Cs are subject to French law. In the event of a dispute, and in the absence of an amicable resolution, it confers jurisdiction on the Courts of Béziers.
